Terms of service

The agreement between BRODV LTD, a company registered in England and Wales under number 17069547, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom and the businesses that use OumsAI to run their stores.

The service

OumsAI is an AI-first platform to run an online store: catalogue, orders, customers, a website and its domain, store email, payments through Stripe, and an assistant that acts on your instructions.

The beta

OumsAI is in a private beta: access is by invitation, the service is free during the beta, and features may change. We give no service-level commitment during the beta. We will give you at least 30 days' notice before any paid plan applies to you.

Your account

You must give accurate details, keep your password and second factor safe, and tell us at once about any unauthorised use. You are responsible for what happens in your workspaces, including what the people you invite and the AI assistant do there on your instructions.

Your store

You are the seller. You are responsible for your products, prices, descriptions, delivery, returns and after-sales service, for your store's legal pages and for complying with the law that applies to your sales, including consumer protection and tax.

Payments to your store go through your own Stripe account, under Stripe's terms. OumsAI never holds your money.

Acceptable use

You may not use OumsAI to sell illegal, counterfeit or dangerous goods, to send unsolicited email, to mislead buyers, to attack or overload the platform or other stores, or to infringe anyone's rights. We may suspend a store or account that does, with notice unless the risk calls for immediate action.

AI features

The assistant and the AI features can make mistakes. Check what they produce before you publish or send it. Actions that spend money or delete data ask for your approval first.

Your content and data

Your content and data stay yours. You give us the right to host, copy and display them only to provide the service. You can export your data at any time.

Fixing a problem with your store

To fix a problem with your store, we may make a temporary copy of its data on OumsAI's own secured equipment, with the personal data of the people in it masked. We delete the copy once the problem is fixed. We make a copy that is not masked only with your written consent.

Our platform

The OumsAI software, design and brand belong to BRODV LTD, a company registered in England and Wales under number 17069547, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. You may use them only through the service.

Liability

We provide the service with reasonable care and skill. During the free beta, and to the extent the law allows, we are not liable for indirect loss, lost profits or lost data, and our total liability is limited to GBP 100. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can close your workspace or account at any time. We can end the beta or your access with 30 days' notice, or at once for a serious breach of these terms. You can export your data during the notice period.

Changes to these terms

We may change these terms and the Data processing agreement, for example for new features, a change in the law or a change in how the service works.

We will tell you about a material change by email and in your account at least 30 days before it takes effect, and explain what changes. A change is material if it reduces your rights, adds obligations for you, or changes how we process your customers' data.

Other changes, such as clarifications or terms for a feature that stays off until you turn it on, apply when we publish them. The date at the top shows the latest update.

If the law or a serious security risk requires a change sooner, we may make it with shorter notice and will tell you why.

If you do not accept a material change, you can close your workspace before it takes effect, at no cost, after exporting your data. If you keep using OumsAI after that date, the new version applies to you. A change never applies to the past.

New subprocessors follow the 30-day notice and objection procedure in the Data processing agreement.

Law and disputes

These terms are governed by the law of England and Wales, and its courts have jurisdiction, without depriving you of protection that the law of your country gives you.
